Crimes of violence are generally the most serious crimes one can be charged with. There is no charge more serious than Homicide. As such they often carry the most serious penalties including sentences of incarceration.

However all violent crimes are not the same. Crimes of violence may include Assault, Robbery, Burglary, certain weapons charges, and Homicide. Crimes of Violence may be charged in varying levels or degrees and as a Misdemeanor or as a Felony depending on the facts and circumstances of the case. Many times individuals are over charged for a crime that includes violence. For example an Assault Case may be charged as both a Misdemeanor or a Felony depending on the injury or the manner in which the crime was alleged to have occulTed. The same may occur in a Robbery, Burglary or Homicide case as well.
